PLEDGE OF ALLEGIANCE AND MOMENT OF SILENCE
The meeting of October 9th, 2008 was called
to order by Chairperson Mary Woznak. All stood and pledged allegiance to
the flag and observed a moment of Silence for our Troops overseas.
ROLL CALL: JOSEPH PERUSO-Present, ROBERT
SPANKO-Present, FRANK BURNS-Present, RANDY VOJTOWICZ-Present, MARY WOZNAK-Present.
ALSO Present: RUSS HEIPLE AND SHANNAN KESTER
GOOD AND WELFARE:
Victoria Svencer: In the August meeting
you had a motion to pay Shelter Memorial $2500.00, $2750.00 $4750.00 out
of the Capitol Reserve. Motion was made passed with the exception of Randy,
who voted against those 3 and then the next month you made the motion to
pay them another $20,000.00. You never rescinded your other motion and
you have 2 valid motions on the board. Randy Vojtowicz we made the motion
to pay all the bills except Shelter and the motion was carried. Then the
next meeting we made the motion to accept their bid at $20,000.00 and to
pay them $10000.00. Russ: It was awkwardly done, but it is correct. Woznak-The
motion in August was to pay all the bills except those 3 which maybe we
need to clarify it because the auditors will question that. Vicki- Ok Thanks.
Woznak: Art did you make the Water Authority
Meeting? Art Thompson- No I could not make it.
Joe Zahoran 219 Pudliner Lane: They are
running sewage up there after you did a really good job on the road and
they are going to tear it up? Are they going to have to fix it? Peruso-
Yes they are going to have to fix it. Mr. Zahoran- I talked to the engineer
and he said they are coming up the middle of the road and I had to give
up 97 feet of my yard and they are coming up the side of Brazil so why
are they changing course to come up Pudliner and if I had to give up 97
feet of my yard then why can’t they make other people give up 10 feet of
their yard. Peruso: We will be addressing that later tonight.
Chris Selfridge: Could you ask Pro Disposal
to not sit at the end of my driveway with the lights flashing and the truck
running at 5:30 in the morning and to put the garbage cans back, not throw
them everywhere? Woznak-We will call Pro and take care of it.
Chris: Also when are you going to take
care of the water runoff up there? Peruso-Not till spring. Chris- I can’t
handle all that run off. Peruso- It will have to be spring because we have
to rent some equipment. Chris- So when spring thaw comes and ruins my wife’s
business who is going to be responsible for the damage? Peruso-It is water
runoff and an act of God, the State dumps their water on us and there is
not much we can do about it. Chris- I will bring up State Case Laws about
that. Peruso- We were just up there looking at that and it is not an easy
fix. Chris- How can someone just put a pipe in on a Township Roadway?
Peruso-We are going to work with you on it and help get it taken care of.

MEETING OF September 11th, 2008
Motion to accept the minutes of the September
11th, 2008 monthly meeting made by Peruso. 2nd by Vojtowicz. All
Ayes. Motion Carried.
TREASURER’S REPORT
Motion to accept the September Treasurers
Report made by Peruso. 2nd by Spanko. Roll Call Vote: Peruso-Aye,
Burns-Aye, Spanko-Aye, Vojtowicz-Aye, Woznak-Aye. 5 Ayes. Motion
Carried.
BILLS TO BE PAID
Motion to pay the bills made by Vojtowicz.
2nd by Peruso. Roll Call Vote: Peruso-Aye,
Burns-Aye, Spanko-Aye, Vojtowicz-Aye, Woznak-Aye. 5 Ayes. Motion
Carried.
CORRESPONDENCES:
The Eads Group: East Taylor Township is
submitting an application for a GP-7 for Minor Road Crossings.
Peruso- This is the application for Hinckston.
Any time you deal with a natural tributary going into a main stream you
need a GP-7 Permit. Woznak-What about East Jackson Street, it is a mess.
Peruso-Nothing, DEP is supposed to be handling that.
REPORT OF THE CHAIRPERSON-Mary Woznak
Thank you to the clean-up crew. The meeting
room looks good.
I came up and worked with Maryann on the
garbage this past month because of the comments made by the auditors and
the decision to go with Pro again and have them do the billing; Maryann
came up with a tentative figure that the garbage is in arrears for 2005,
2006 and 2007 for around $12,000.00. I contacted 2 different collection
agencies. The Credit Bureau will charge 25% of whatever they collect and
I spoke to Joe Varanese at 1st Credit and they collect our full amount
and charge their fee on top of what the people owe, so we get 100% of our
money. Burns- Do they get their money 1st? Woznak- no he explained to me
that we would get 100% of our money and charge their fee on top of that
to the resident. Burns- But do they take their share 1st, because you have
to be careful, say if someone owes $100.00 and their collection fee is
$20.00 so now the person owes $120.00 and they make a payment of $20.00
and the company takes there fee of $20.00 off the top and the people quit
paying and we don’t get our money. Spanko- Do we have a right to take people
who have already been taken to Zanghi’s? Heiple- No, if we already have
an agreement we have to stick to it. Woznak- We can hold off until I can
get them here to explain it better. Motion made to table the Collection
Agency idea until we get the reps here to go over all the options made
by
Peruso. 2nd by Burns. All Ayes. Motion Carried.
I received a letter last month from the
Jackson/East Taylor Sewage Authority last month, Woznak read letter to
everyone ( Copy of the letter is attached). Peruso- I will address that
on my report.
REPORT OF THE VICE-CHAIRMAN- Frank
Burns
I have been doing research on the shared
service agreement with some of the surrounding Townships and they share
anything from the purchase of a police car, to equipment, ect. and I think
this is a god idea and something we need to look into. Peruso-We sort of
have an agreement with other Townships around us, to use their stuff or
let them use ours. And the State has an agility project that helps us.
Burns- They have special grants for Townships that participate in this
and I think that it is a way to help out the Township.
REPORT OF THE ROADMASTER-Joe Peruso
The new building is up and everything
is under roof.
Do we have to bid out for heating oil?
Heiple- if you spend under $10,000.00 no you do not have to. Discussion
on bidding for heating oil with a Motion made by Peruso to look into bidding
for fuel oil. 2nd by Vojtowicz. 5 Ayes, Motion Carried.
There are 2 things wrong with their letter
that I forgot about. We are in a property dispute with them and there may
only 1 resident up there that is in Jackson Township, not 4 and they know
that.
Peruso read letter of response to Jackson/East
Taylor Sewage Authority (copy of the letter attached). Motion to approve
letter written to JESTSA and have it hand delivered made by Woznak. 2nd
by Vojtowicz. 5 Ayes. Motion Carried.
Joe Zahoran: We have an Ordinance
that says we are exempt if we are 150 feet back from the line and that
Ordinance is no good because they can take eminent domain. I am 200 feet
away and they took 97 feet of my property by eminent to get passed that
Ordinance. Woznak - it is not that our Ordinance is wrong it is
just how they did it. A lawyer looked into it and said that someone will
never win against that because it is for the betterment of the community
so why do you even have that still on your books because why should you
pay $5000 or $6000 instead of $2000 for the tap-in when you will never
win. So that Ordinance means nothing to JETSA because they just stuck mean
and the Ordinance is meaningless because you will never win. Getting to
you about the letter, Mr. Burkey flat out lied to me. I am not going to
condemn the man; I just do not trust him at all. You guys are right at
what you guys did in tar and chipping the road and the timing and Mr. Burkey
is wrong. And now they are going to tear it up and it makes no sense.
Peruso- They are going to have
to fix it.
Mr. Zahoran- I am watching them
on Brazil Lane and they are going up the side of the road and only taking
10% of that road so why are they treating Pudliner any different. Chris
Selfridge- I think the problem with Pudliner id the water lines. I
talked to the engineer and he said that there is a water line on both sides
of the road. 1 that feeds the tank is on one side and one that feeds the
Township is on the other.
Chris Selfridge- Would it benefit
the Supervisors to change your meeting so it does not coincide with their
meeting so you can have a Supervisor attend and have some representation
there? Peruso-we have people there on the Board and I think that
if anyone should change their meetings it should be them. Woznak-read the
minutes. It was brought up in all but one of them approved to not change
the meeting
POLICE REPORT-Randy Vojtowicz
Nothing to report.
Chris Selfridge: The Police did
a good job on the bank robbery that occurred.
Mary Woznak- Please let them know
that there is an increase of gunfire at the far end of the dump. Vojtowicz-They
do that every year for hunting season. Woznak- This was before. Peruso-
This is Pa. Spanko- where Riders Dump? Woznak-Yes. Vojtowicz-which
end? Woznak- I don’t know. Vojtowicz- because we only own
a little bit of it, do we even know if it was in the Township. Woznak-
I don’t know. All I was told was to relay the information to the Police
Department. Woznak-Did you ever call the game commission? Vojtowicz-yes
that was taken care of. And that truck has been removed down there at the
garage.
REPORT OF THE BUILDING SUPERVISOR-Bob
Spanko
The only thing we need on the new building
is rainspouts and I was wondering if I could get a section of rainspout
about 37 feet for the old building because we are getting a lot of water
and when it freezes up in the winter it is a real problem. I was going
to see if they would give me a quote when they come up to do the new building
or if I have to advertise?
Heiple- will it be under $4000.00?
Spanko-yes
it won’t even be close to that not even over $1000.00.
Heiple- then
you don’t need to get bids for that. Mary-just get a quote and bring
it to the next meeting. Spanko- I wanted to get it done now. Peruso-
It needs to be done right away. Spanko- I know Jim who does rainspouts
and he said he could give us a good deal. So I will talk to him and talk
to the people coming up and whoever is cheaper I will get them to do it.
The Veterans Memorial is coming along good
and I would like to start advertising for the names as soon as possible.
Woznak-
When are you going to meet with the guys from the Legion?
Spanko-
What does the Legion want me do? I’ll just go down there and ask them to
give me all their money. Woznak- They want to be involved. Peruso-
They want to feel involved and can possibly get us grant money for the
Memorial if they don’t feel involved. Vojtowicz- When is the meeting down
there? Shannan- The 2nd Tues of every month, so it is on Oct. 14th,
at 7:00 P.M. Vojtowicz- Someone should go down to the meeting and talk
to them. Joe and Bob will attend the Legion Meeting.
Discussion on the criteria about advertising
and going out to Jackson to see what they do.
Woznak- We need to have some kind
of organization before we jump into this with both feet or it will be a
fiasco.
Discussion on the Veterans Memorial.
Spanko stated that he will go up to Jackson and I will come and explain
it to you.
I would like to talk to PennDot about
taking over the grassy part of the Diamond if they would donate that to
us and make a park, like down there on Bedford Street, put flowers and
a sign. Supervisors agreed that would look very nice. Heiple-even
if the State won’t give it to you they may let you take care of. And that
might be considered an agility project.
ENVIROMENTAL REPORT-Bob Ritchey

SOLICITORS REPORT-Russ Heiple
About 2 years ago we put together an Ordinance
for the East Conemaugh Police to patrol down at the school because we had
no one here. So they could make arrests and things. The School Solicitor
called me and said East Conemaugh has finally signed it and the School
District is interested in having the Township sign it and get it to them.
Vojtowicz-
the Principal and I had words and I informed him that we now have Police
on Monday through Friday daylight so we have our own police to take care
of the school and that our department is in charge when anything arises
at the school. And as far as us signing anything, we never signed anything.
Heiple-I will relay that back to them
I took a trip down Knauer Lane and looked
it over. Shannan and I took a look the Ordinances and the only thing it
states is growth, shrubbery etc. and the Motor Vehicle Codes doesn’t prohibit
it either. Peruso-but it is on the property line. Heiple-I
know we have talked about a 2 foot setback and we cannot find anything
in the Ordinances about that either Woznak-what about the right
of way. Peruso- it is not maintained by the Township so it reverts
to the property owners. After 21 years and we don’t use it, it reverts
back to the property owner. Spanko- has anyone talked to him yet.
Vojtowicz-
We have been hashing this out for 6 months. Spanko-didn’t you send
him a letter? Woznak-No we can’t send him a letter if he is doing
nothing wrong. Heiple- we can send him a letter on diplomacy and
in the concern for public safety and see what happens. I will get on that.
OLD BUSINESS
Resolution for Sewage Authority- Heiple-JETSA
is going to put something together for that
Ordinance Assessment-Heiple- I
am weeding those out as we go
Jackson Township Multi Comprehensive Plan-Shannan
I
reviewed some of it and I don’t think that there is anything we need to
worry about in it.
NEW BUSINESS
Trick or Treat Night-purchasing candy
and some decorations
Motion to spend $350.00 out of the Recreation
fund for Trick or treat night made byVojtowicz. 2nd by Burns. Roll
Call Vote: Peruso-Aye, Burns-Aye, Spanko-Aye, Vojtowicz-Aye, Woznak-Aye.

Peruso-I prefer Trick or Treat night
up here instead of downstairs. We have too much going on downstairs. Woznak-
What about the traffic and who is going to volunteer to help out. Vojtowicz-
We are going to have 3 or 4 cops out that night. Shannan- I was
going to ask you if we could have a police officer here at the building
with us. Vojtowicz- no problem we can have someone up here with
you for traffic control.
